These Terms & Conditions govern your use of our website and the purchase of products from Blueberry Goose (PTY) LTD, registration number 2026 / 558409 / 07.

In these Terms & Conditions, “we”, “us”, “our” and “the Company” refer to Blueberry Goose (PTY) LTD. “You” and “the customer” refer to any person using this website or purchasing our products.

By using this website or placing an order, you agree to these Terms & Conditions.

These Terms & Conditions are intended to comply with applicable South African law. Nothing contained in these terms is intended to exclude or limit any rights that you may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable legislation.


1. ABOUT OUR BUSINESS

Blueberry Goose (PTY) LTD is a South African business specialising in handmade products.

Our products are made with care and attention to detail. Because our products are handmade, minor variations in stitching, fabric placement, texture, sizing or appearance may occur.

These minor variations are a natural characteristic of handmade products and do not automatically constitute a defect.

We nevertheless strive to ensure that every product meets a high standard of quality before it is sent to a customer.


2. USING OUR WEBSITE

You agree to use this website only for lawful purposes.

You may not:

  • Use the website for fraudulent or unlawful purposes;
  • Attempt to gain unauthorised access to the website or its systems;
  • Interfere with the security or operation of the website;
  • Copy, reproduce or commercially exploit our content without permission;
  • Use our photographs, branding, designs or product descriptions without written permission; or
  • Provide false or misleading information when placing an order.

We reserve the right to refuse or cancel an order where we reasonably suspect fraudulent, unlawful or abusive activity.


3. PRODUCT INFORMATION

We make reasonable efforts to ensure that all product descriptions, photographs, measurements, colours and other product information displayed on our website are accurate.

However:

  • Colours may appear slightly different depending on your device or screen;
  • Handmade products may contain minor variations;
  • Measurements may have minor manufacturing tolerances; and
  • Fabric patterns may differ slightly from photographs depending on where the fabric is cut.

These variations do not constitute a defect where the product remains fit for its intended purpose and substantially corresponds with its description.


4. PRODUCT AVAILABILITY

Products displayed on our website are subject to availability.

We make reasonable efforts to keep our online stock information accurate. However, because products may also be sold through other channels, an item may occasionally become unavailable before our website is updated.

If we are unable to fulfil an order because a product is unavailable, we will contact you and provide an appropriate remedy, which may include a replacement, exchange or refund, subject to applicable law.


5. PRICES

All prices displayed on the website are in South African Rand (ZAR).

Product prices may change from time to time. The price applicable to your order will generally be the price displayed at the time your order is placed.

Delivery charges are separate unless expressly stated otherwise and will be calculated or displayed at checkout.

We reserve the right to correct obvious pricing or product information errors.

If an order has been placed based on an obvious error, we may contact you to confirm whether you wish to proceed at the correct price. If you do not wish to proceed, any payment received will be refunded as required by law.


6. PLACING AN ORDER

Customers can currently place orders through our website as guest customers without creating an account.

When placing an order, you are responsible for ensuring that the information supplied is accurate and complete, including:

  • Your name;
  • Contact details;
  • Email address;
  • Delivery address; and
  • Any applicable PUDO Locker or delivery information.

Once an order has been successfully submitted and payment has been received or confirmed, we will process the order for fulfilment.

An automated order confirmation may be sent to the email address supplied during checkout.

An order confirmation does not necessarily constitute acceptance where an order cannot reasonably be fulfilled, such as in the case of an obvious pricing or availability error.


7. PAYMENT

Online payments are processed through PayFast.

We do not intend to store customers’ complete payment card or banking details on our website.

Payment information is processed through the applicable payment provider and may be subject to that provider’s own terms and privacy policy.

For purchases made at physical markets or events, we may accept payment using Yoco or other payment methods made available by us.


8. DELIVERY

8.1 Local Delivery

Johannesburg is currently considered our local delivery area.

Local delivery costs are calculated at checkout based on the applicable delivery method and destination.

8.2 National Delivery

We offer delivery within South Africa.

Our national courier service may vary from time to time. We currently use PUDO Lockers for applicable deliveries.

The courier or delivery service available for a particular order will be communicated at checkout or during the order process.

Delivery timeframes are estimates and may vary depending on:

  • Destination;
  • Courier availability;
  • Public holidays;
  • Peak periods;
  • Weather;
  • Operational disruptions; and
  • Circumstances outside our reasonable control.

8.3 Incorrect Delivery Information

The customer is responsible for providing accurate delivery information.

If an order cannot be delivered because incorrect or incomplete information was provided by the customer, additional delivery charges may apply.

Where a parcel is returned to us as a result of incorrect delivery information, the customer may be responsible for the cost of re-delivery.

8.4 Courier Delays

We will make reasonable efforts to assist customers with delayed deliveries.

However, once an order has been handed to an independent courier or delivery service, certain aspects of the delivery process are outside our direct control.

We cannot guarantee courier delivery dates unless a specific delivery commitment has been expressly agreed with the customer.


9. DAMAGED DELIVERIES

Customers should inspect their parcel and product as soon as reasonably possible after delivery.

If your parcel arrives visibly damaged, please:

  1. Take clear photographs of the damaged parcel;
  2. Take photographs of the damaged product;
  3. Keep the original packaging;
  4. Contact us as soon as possible; and
  5. Provide your order details and photographs when reporting the issue.

Photographs may be required to assist us in determining whether damage occurred during delivery.

Where a product is confirmed to have been damaged during delivery, we will provide an appropriate remedy in accordance with applicable law.


10. RETURNS AND EXCHANGES

We want you to be happy with your purchase.

Our standard return request period is 7 days from the date of delivery.

Products returned for ordinary returns should generally be:

  • Unused;
  • Unwashed;
  • In their original condition;
  • In their original packaging where reasonably possible; and
  • Accompanied by the relevant order information.

The 7-day period does not remove or limit any statutory consumer rights that may apply to a particular transaction.

10.1 Change-of-Mind Returns

Where permitted by applicable law, customers may request a return because they have changed their mind or no longer require the product.

For a change-of-mind return, the customer is responsible for the cost of returning the product to us.

Where a refund is approved, the refund will generally apply to the purchase price of the product. Original delivery costs may not be refundable where applicable law permits this.

10.2 Incorrect Products

If we send you the wrong product, please contact us as soon as possible.

Once the issue has been verified, we may provide:

  • The correct product;
  • An exchange; or
  • A refund.

Where the incorrect product was supplied by us, we will be responsible for reasonable return and replacement delivery costs, subject to applicable law.

10.3 Damaged or Defective Products

If your product arrives damaged or contains a significant manufacturing defect, please contact us as soon as possible.

Minor imperfections associated with handmade production do not automatically constitute defects.

Examples of minor handmade variations may include slight differences in stitching or fabric positioning.

Significant manufacturing errors that affect the quality, usability or intended purpose of a product may qualify for a remedy.

Depending on the circumstances, the remedy may include a repair, replacement, exchange or refund.

Returned products may be inspected before a remedy is processed where reasonably necessary.

Nothing in these Terms & Conditions limits a customer’s statutory rights regarding defective goods.


11. CUSTOM AND PERSONALISED PRODUCTS

We do not currently offer personalised products.

If personalised or custom-made products are introduced in the future, specific terms will be provided before the order is placed.

Because personalised products are made specifically for an individual customer, they may generally not qualify for a change-of-mind return.

However, defective, damaged, incorrectly manufactured or otherwise non-compliant personalised products will be dealt with in accordance with applicable law.


12. REFUNDS

Where a refund is approved, it will generally be processed using the original payment method where reasonably possible.

The time taken for the refund to reflect in your account may depend on the payment provider or financial institution.

Where a replacement or exchange has been agreed, the replacement will generally be processed once the original product has been returned and assessed where an assessment is reasonably required.


13. BABY PRODUCT CARE

Our products are washable and are supplied with appropriate care and washing instructions.

Customers are responsible for following the supplied care instructions.

This includes following instructions relating to:

  • Washing temperature;
  • Detergents;
  • Drying;
  • Ironing;
  • Storage; and
  • Other care requirements.

Damage resulting from failure to follow the supplied care instructions may not qualify as a product defect.


14. CUSTOMER ACCOUNTS

Customers currently check out as guests.

If customer accounts are introduced in the future, customers may be able to create an account to access features such as:

  • Viewing previous orders;
  • Managing personal information;
  • Saving delivery information;
  • Tracking orders; and
  • Accessing other account features.

Customers will be responsible for keeping their account login details confidential.

We reserve the right to suspend or terminate accounts where there is reasonable evidence of misuse, fraud or violation of these Terms & Conditions.

Additional account terms may be introduced when account functionality becomes available.


15. INTELLECTUAL PROPERTY

All content on this website belongs to Blueberry Goose (PTY) LTD or is used with permission unless otherwise stated.

This includes:

You may not copy, reproduce, modify, distribute or commercially exploit our content without our prior written permission.
